Terms of Service

These Terms of Service ("Terms") govern your use of Card Curator ("the Software"), a macOS application sold and distributed by Brian Moore as a sole proprietorship ("we," "us," "our"). By purchasing, downloading, installing, or using the Software, you agree to these Terms. If you do not agree, do not purchase or use the Software.

1. License Grant

Upon purchase, we grant you a non-exclusive, non-transferable, perpetual license to use the Software, subject to these Terms. Your license is for one (1) Mac at a time. You may move the activation to a different Mac by deactivating the license on your current Mac through the in-app License panel; this releases the activation slot for re-use on another Mac you own and control.

2. Free Trial

The Software is available for free trial use with a limit of ten (10) saved cards. The trial does not require purchase, registration, or payment information. No license key is needed. Once the cap is reached, additional features that require saving cards will be locked until you purchase a license.

3. Purchase and Activation

Purchases are processed by Lemon Squeezy, our authorized payment processor and merchant of record. Following a successful purchase, you will receive a license key by email. To activate, paste the key into the License panel inside the Software. Activation contacts the Lemon Squeezy License API to validate the key and bind it to your Mac. The Software will then unlock unlimited card storage and all premium features.

4. Permitted Use

You may use the Software for personal collection management, including for any commercial activity that you conduct as the owner of the collection (e.g., selling cards from your own collection on platforms such as eBay). You may not:

You are responsible for keeping your license key confidential. Sharing your key with another person or installing it on more than one Mac simultaneously violates these Terms and may result in deactivation of the license. If your key is exposed (e.g., posted publicly), contact us at support@cardcurator.app and we will issue a replacement at our discretion.

6. Updates

The Software includes an optional automatic update mechanism (Sparkle 2). We provide updates as we develop them, including bug fixes, new features, and security patches, for the lifetime of the major version you purchased. We do not guarantee that future major versions will be free or covered by your existing license; if a paid major upgrade is offered, we will provide notice in advance and continue to support the current major version for a reasonable transition period.

7. Third-Party Services

The Software offers optional integrations with third-party services (eBay, CardHedge, Anthropic, and the community Marketplace via Apple's CloudKit). Use of these integrations is governed by the respective third party's terms. You are responsible for the credentials you supply for these services. We do not store, see, or proxy your third-party credentials — they are kept in the macOS Keychain on your Mac.

8. Community Marketplace

The Software includes opt-in community marketplaces for sharing Space templates and Themes via Apple's CloudKit public database. By publishing content to the marketplace, you grant other Card Curator users a non-exclusive, royalty-free license to install and use the published content within the Software. You retain ownership of the underlying content. You must not publish content that infringes any third party's intellectual property, that contains illegal material, or that violates the marketplace community standards documented inside the app. We may remove published content at our discretion if it violates these Terms or applicable law.

9. Privacy

Your use of the Software is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Intellectual Property

The Software, including its source code, design, branding, and documentation, is the intellectual property of Brian Moore. These Terms grant you a license, not ownership. The "Card Curator" name and logo are trademarks of Brian Moore.

12. Disclaimers

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

The Software is a tool to help you manage a collection. It is not a substitute for professional advice on insurance, valuation, taxation, or estate planning. You are responsible for verifying the accuracy of all information you enter or import into the Software, and for any decisions you make based on that information.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14. Termination

You may stop using the Software and uninstall it at any time. We may suspend or terminate your license if you materially breach these Terms (for example, by sharing your license key publicly or attempting to circumvent activation). Upon termination, you must cease using the Software and remove it from your Mac. Sections 4, 5, 8, 10, 12, 13, 16, and 17 survive termination.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. For material changes, we will notify existing license holders by posting an update notice on this page and, where reasonably possible, in-app at next launch. Continued use of the Software after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the United States and the State in which Brian Moore is resident, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Software will be resolved in the courts of that jurisdiction. If you reside in a jurisdiction with consumer-protection laws that grant you rights that cannot be waived (such as the European Union, the United Kingdom, or Australia), nothing in these Terms is intended to limit those rights.
